1. About this Policy

Sheopals Private Limited (hereinafter referred to as “We/Our/Company”) is a company incorporated and registered under the Companies Act, 2013 having CIN U74999DL2016PTC301589 and registered office address at E-44/10, Okhla Industrial Area, Phase 2, Entire First Floor, Okhla Industrial Estate, South Delhi, New Delhi, Delhi, India, 110020. 

1.2. The Company has developed a website https://www.sheopals.com/ (hereinafter referred to as the “Website”) for the purpose of selling ayurvedic healthcare products manufactured by the Company. 

1.3. This Policy serves as a Privacy Notice for the Website and the Services as defined herein this Policy. It underlines how we process your personal information and how you can exercise your rights regarding the same. 

 

2.    Scope and applicability

2.1. This Privacy Policy is subject to the Indian jurisdictional law and is to be construed  in accordance with the provisions of Information Technology Act, 2000 and Rules made thereunder, the Digital Personal Dara Protection Act, 2023 (Applicable Data Protection Laws), and other applicable law enacted from time to time.  

2.2. This Privacy Policy shall be read in conjunction with the Terms of Use of the Website. 

3. Definitions For the purposes of this Privacy Policy:

a) Account means a unique account created for you to access our Service or parts of our Service.

b) Company refers to Sheopals Private Limited who shall be deciding the means and purpose  processing of PII under this Policy

c) Consent means an affirmative action that signifies agreement to the processing of their personal data.

d) Minor shall mean any person below the age of 18 years. 

e) Personal Information/PI  includes any information or set of information, whether alone or in combination with other personal information which is sufficient to identify the User

f) Service (s) refers to products and/or services provided by the Company through the Website

g) Service Provider refers to third-party companies or individuals employed by the Company, to provide the Service on behalf of the Company, to perform services related to the Service.

h) Usage Data refers to data collected automatically, generated by the use of the Services on the Website.

i) You/Your/User means the individual accessing or using the Service/Platform, or the company, or other legal entity on behalf of which such individual is accessing or using the Service/Platform, as applicable.

 

4. Processing of Personal Information by the Company

When you use any of Our Services you share some PI with Us. We use the PI. To communicate with your regarding your interests and orders we help you to create an account. You can use the same account to get in touch with us. We offer free consultations and then you may share some more information with regarding your concerns.  When you make a purchase, we will need the location information to make a delivery. In order to keep track of your purchases we shall keep record of the same, but we shall store none of the financial information.

 

5. Sharing and Disclosure of Personal Information

5.1. We value Our brand and Your privacy. We do not sell or otherwise disclose Your PII that we collect about you for monetary or other valuable consideration.

5.2. The Entities We share and disclose Your PI for lawful purposes which include:

5.2.1. Third Party Service Providers: We share your PI with third-party Service Providers including but not limited to payment processors/gateways, vendors, shipping and delivery service providers and e-commerce service providers for the purpose of fulfilling their contractual obligations.

5.2.2. Affiliates and Subsidiaries: We may disclose information about you to our affiliates, subsidiaries and other businesses under our control and ownership subject to the same privacy policy.

5.2.3. Legal Disclosures: We may disclose Your PII where such disclosure to legal authorities and representatives is necessary to comply with applicable laws.

5.2.4. Business Transfers: In the event the Company undergoes any merger, acquisition, or sale of company assets, in part or in full, with another company, or in the unlikely event that the Company goes out of business or enters bankruptcy, any processing of Your PII would still be subject to the terms of this Privacy Policy.

 

6. Transparency as to the Rights of Users 

6.1. When the PI belongs to you, law gives you the right to know how your information has been used by the company. You can exercise any of Your rights by writing care@sheopals.in .

6.2. The Company shall respond to the requests made by the Users within a reasonable timeframe as practicably possible in a concise, transparent and easily accessible form and format. In case where the Company is unable to process the request of any Data Principal, the Company shall duly provide such User with a justifiable reason for the same. The Company reserves to right to refuse to entertain any frivolous and/or repeated requests.

6.3. If you choose to withdraw your consent for processing of your PI, further processing shall cease, however, the withdrawal of consent shall not be applicable on the information already processed by the Company. 

6.4. If you choose to make a request for erasure of your PI, we shall delete Your PII unless retention is necessary to fulfil our contractual obligations or legal compliances under any law for the time being in force. Wherever, deletion of PII is not possible, we shall anonymize, the said information in a way that it no longer identifies You.

6.5. With your consent we may share details of our upcoming products etc. You may choose to unsubscribe from and such communication by simply clicking on the unsubscribe link that is present at the bottom of each email.

 

7. Information Security

We implement reasonable, technical and organizational measures to protect your PI from unauthorized access, disclosure or misuse. However, no method of transmission over the internet or electronic storage is 100% secure. 

 

8. Children’s data

The Company does not target and/or seek to collect any PI of individual below the age of 18 years. If You are a parent/ lawful guardian and believe your child has provided us with PI, please contact us at the email Id, specified in Clause 6 to request deletion.

 

9. Cross Border transfer of Your Personal Data

This Policy governs the processing of PI collected through the Website within the territory of India. It also applies to the processing of PI outside of India, where such processing is related to offering goods or services to Data Principals within India through the Website.

 

10. Third-party links Technology integration and social media

10.1. The Website includes links to third party websites, platforms we do not operate or control. Your engagement with such third-party links/websites shall be subject to the terms of such third-party website policies.

10.2. You may choose to engage with Us through links on other third party websites. In such cases, the PII You share with Us shall also be subjected to such third-party website policies.

10.3. Based on your consent we may engage and communicate with You through social media platforms, including but not limited to WhatsApp and Instagram. The usage and processing of Your PII over such platforms shall also be subject to the Privacy Policies of the respective social media platforms.

11. Notices and Revisions

We may update Our Privacy Policy from time to time. We will notify You of any changes by posting the new Privacy Policy on this page. We will let You know via email and/or WhatsApp, prior to the change becoming effective and update the "Last updated" date at the top of this Privacy Policy.
